General Term & Conditions

1. Scope

These General Terms and Conditions govern all offers, sales, purchases, sourcing mandates and related services provided by Station to Station Vintage Watches GmbH, hereinafter referred to as “Station to Station”, through its website, by email, telephone, WhatsApp, social media, in person or through any other communication channel. They apply to both private and commercial customers unless expressly agreed otherwise in writing. By placing an order, accepting an offer, paying an invoice or otherwise confirming a transaction, the customer accepts these General Terms and Conditions in the version applicable at the time the contract is concluded. Any customer terms that conflict with these General Terms and Conditions shall apply only where expressly accepted by Station to Station in writing.

2. Nature of the Watches

Station to Station specialises in vintage, neo-vintage and pre-owned watches. Because of their age and individual history, watches may show signs of use, ageing, previous polishing, restoration, servicing or replacement of individual components. Variations in patina, colour, finishing, dimensions, timekeeping and water resistance are normal characteristics of vintage and pre-owned watches and do not in themselves constitute defects. Each watch is sold in its condition at the time of sale, subject to the description, photographs, condition report and any disclosures made to the customer before the transaction. Photographs form part of the description but may not reproduce colours, patina, surface condition or proportions with complete accuracy due to lighting, screen settings and photographic conditions.

3. Descriptions and Information

Station to Station prepares descriptions and condition assessments with reasonable care and based on the information available at the time of sale. References to originality, period correctness, rarity, production period, service history, provenance or component configuration represent Station to Station’s professional assessment and are not necessarily confirmations issued by the original manufacturer. Any obvious drafting, pricing or calculation error may be corrected by Station to Station before delivery. Where a material error affects an accepted order, the customer will be informed and may either accept the correction or cancel the order.

4. Authenticity

Station to Station warrants that every watch sold is, to the best of its knowledge and professional assessment, authentic in the sense described in the relevant offer, invoice or condition report. A vintage or pre-owned watch may contain service parts, period replacement parts, later replacement parts or restored components. Such components do not make the entire watch counterfeit where they have been disclosed or are consistent with the description provided before sale. The customer must notify Station to Station immediately if the authenticity of a watch is questioned and must not open, alter, service or submit it to destructive testing without prior written approval. Any authenticity determination must be made by Station to Station, the relevant manufacturer or an independent specialist mutually accepted by both parties.

5. Offers and Formation of Contract

Website listings, social-media posts, advertisements and verbal indications are invitations to make an offer and are not binding offers unless expressly identified as such. A purchase contract becomes binding when Station to Station confirms the order in writing, issues an invoice, or receives payment. Once a binding contract has been concluded, the customer may not cancel the purchase merely because they have changed their mind. Station to Station may decline or cancel an order where the watch is no longer available, payment is not received on time, the customer fails compliance checks, fraud or unlawful activity concerns arise, or a manifest pricing error has occurred.

6. Prices

All prices are stated in the currency shown in the relevant offer or invoice. Unless expressly stated otherwise, prices include Swiss VAT where legally applicable; exclude delivery, insurance, customs duties, import taxes and foreign charges; exclude bank, card, currency-conversion and intermediary-bank charges. The customer must ensure that Station to Station receives the full invoice amount without deductions. Any tax, duty, customs charge or fee imposed outside Switzerland is the sole responsibility of the customer.

7. Payment

Unless otherwise agreed in writing, all invoices are payable in full immediately upon receipt and before delivery or collection. Payment must be made using the exact beneficiary details. The customer bears the risk of inaccurate beneficiary details, incomplete payment references, bank rejection, currency conversion, bank delays, and intermediary or recipient-bank charges. Payment is complete only when the full cleared amount has been credited to the account designated by Station to Station. Station to Station is not required to release or reserve a watch until cleared funds have been received. Where payment is late, Station to Station may place the customer in default, withdraw from the contract, or release the watch for sale to another customer.

8. Deposits and Reservations

A watch is reserved only after Station to Station has confirmed the reservation in writing and received any required deposit. Unless otherwise stated in writing, a deposit is credited against the purchase price. Where the customer fails to complete the transaction within the agreed period, Station to Station may cancel the reservation and retain the deposit as compensation for its costs and lost sales opportunity. Where Station to Station cannot complete the sale for reasons attributable to it, any deposit received will be refunded.

9. Anti-Money-Laundering and Compliance

Station to Station may request identification, proof of address, or other documents reasonably required for legal, banking, insurance, or compliance purposes. The customer agrees to provide accurate and complete information promptly. Station to Station may refuse, suspend or cancel a transaction where information is incomplete, inconsistent or gives rise to compliance concerns. Cash payments may be refused or limited at Station to Station’s discretion.

10. Delivery and Collection

Delivery dates are estimates unless expressly guaranteed in writing. A watch may be collected personally, delivered by Station to Station, or delivered through a courier. The customer must provide a complete and secure delivery address before shipment. Any change of delivery address requires prior approval. Station to Station may require identification, a signature, or an access code at delivery. Partial deliveries are permitted where reasonable.

11. Transfer of Risk

Where the customer is a private consumer and Station to Station arranges delivery, risk transfers in accordance with mandatory law. In all other cases, risk transfers when the watch is handed to the carrier. Where a shipment is insured, any compensation remains subject to the carrier’s or insurer’s terms. The customer must inspect the package immediately upon receipt and document visible damage before opening it. Loss, damage or suspected tampering must be reported to Station to Station immediately, and no later than twenty-four hours after delivery.

12. Title

Legal title to the watch remains with Station to Station until the complete purchase price and all associated charges have been paid in cleared funds. The customer may not sell, pledge, alter or otherwise dispose of the watch before full payment. Station to Station may arrange for a retention-of-title entry where legally required or appropriate.

13. Inspection and Notification of Defects

The customer must inspect the watch promptly after collection or delivery. Any visible discrepancy, damage or defect must be reported to Station to Station in writing without delay and supported by photographs where appropriate. A defect discovered later must be reported immediately after discovery. The customer must stop using the watch where continued use may cause further damage. Failure to notify Station to Station promptly may result in the watch being deemed accepted.

14. One-Year Warranty

Station to Station provides a warranty of twelve months from the date of sale for every watch sold, unless a different period is expressly stated. The warranty covers material defects in proper mechanical functioning under normal use. The warranty is limited to inspection, adjustment, repair, or replacement of a defective component at Station to Station’s discretion. The customer has no automatic right to cancellation or refund where the defect can reasonably be remedied. The warranty period is not restarted following a repair.

15. Warranty Exclusions

The warranty does not cover normal wear, ageing, cosmetic changes, or damage caused by impact, impact, or improper storage. Misuse, negligence, overwinding, water damage, or theft are excluded. Accuracy variations appropriate to age are not covered. Unauthorized servicing, opening, or alteration voids the warranty. Water resistance is excluded unless confirmed in writing at sale. Even where tested, it may diminish through age and impact.

17. Returns and Right of Withdrawal

Except where expressly agreed or required by law, all sales are final. Station to Station does not provide a general right of return for change of mind or dissatisfaction with personal preference. Where a return is voluntarily agreed, the watch must be returned within the agreed period, unworn, in unchanged condition, with all boxes/accessories, by approved insured transport. Station to Station may deduct loss in value and administrative costs.

21. Limitation of Liability

To the fullest extent permitted by law, Station to Station is liable only for direct damage caused by intentional misconduct or gross negligence. Liability for indirect damage or consequential loss is excluded. Station to Station is not liable for delays outside its control, including customs, inspections, strikes, or natural events. Nothing excludes liability that cannot lawfully be excluded, such as personal injury where mandatory law applies.

27. Governing Law and Jurisdiction

These General Terms and Conditions are governed exclusively by substantive Swiss law. Subject to mandatory consumer rules, the exclusive place of jurisdiction is Zurich, Switzerland. Station to Station may also bring proceedings at the customer’s domicile. If any provision is held invalid, the remaining provisions remain effective.
